Anticipatory Bail in India: When You Need It and How to Apply
If you fear arrest in a case that has not yet been decided, anticipatory bail can protect your liberty. Here is how it works.
Anticipatory bail is a direction that if a person is arrested, they shall be released on bail. It is meant for people who reasonably apprehend arrest in a non-bailable offence.
Where to apply
You can approach the Sessions Court or the High Court. Courts consider the nature of the accusation, your antecedents and whether you are likely to flee or tamper with evidence.
Conditions you may face
- Joining the investigation when called
- Not leaving the country without permission
- Not contacting witnesses
Apply early. A carefully drafted application that addresses the court's concerns upfront improves the chances of interim protection at the first hearing.
